The
joint ownership of common land requires co-operation between the owners
and a framework in which decisions can be ordered and managed. There
are also different levels of control over activities within the
development depending on the activity. Some aspects, such as minimum
building energy efficiency, maximum building/vegetation height etc are
set down by covenants on the property
title. These remain a legally binding obligation attached to that
parcel of land.
Below this level are the rules of the Residents’ Association. These
govern the way in which members of the society interact or what they
may do. These rules are initially established by the developer but may
be changed over time by democratic process according to the wishes of
the residents. The rules are binding as long as they form part of the
constitution of the Residents’ Association.
Lastly there are guidelines, which inform the owners of issues that are
deemed worthy of consideration in the way we act and interact with each
other. These guidelines are not binding but provide guidance and
reminders on issues such as goodwill, ecological principles and
of course, energy efficiency.
